Rocky Mountain Homes (RMH) asked for an $8000 deposit and applied it to preliminary drawings. They did say it was nonrefundable, but that didn’t matter because it would be applied to the final amount for all the final drawings and costs. We built another log cabin in another state and wanted the same plan used here. While they drew up the AutoCAD sketches off our own plans we provided, they sent us their contract to sign that was very vague. We were perplexed by this ambiguous contract so asked our contractor for our current log home to look at RMH’s contract and see if it was good and fair. He said the contract didn’t protect us and took away their liability for anything that could go wrong and put it on us, the owner—for example, the transportation of the logs to the site, their employees getting hurt and suing us, for example. When asking Dave, the salesman, about our concerns, he became defensive and incredulous; treated us like we didn’t know anything. While negotiating and rewriting the contract, the final cost number was presented to us… but it was missing key items we had agreed to. After continually insisting we were wrong, Dave, “remembered” that RMH had said they would include these key items in the final price.
The final straw for us, Dave insisted it was an industry standard to require a nonrefundable deposit of one quarter of the total amount ($75k) be paid immediately upon signing the contract and before final plans were drawn up. Our red flags were in fully blowing as I called other custom log building companies and found they do not do this large of a deposit practice as well as all deposits were refundable less work already done. After I found this out we just couldn’t work with Dave and RMH. I asked for our initial $8000 back less the pay for the draftsman to do the preliminary sketches, like these other companies do…. the answer was “no”. Even though it was a huge amount of money for us, I am so glad we only lost $8000.00 with this company and not $75k or even our whole amount of over $300k. Our red flag was right on, liability was with the owner. Please please look at other companies in Montana. Do your due diligence in seeking the right company for your dream log home.
